Section 504 of the Rehabilitation Act of 1973

Bay District Schools provides accommodations for eligible students under Section 504 of the Rehabilitation Act of 1973. Section 504 is a civil rights statute that provides:

No otherwise qualified disabled individual in the United States...shall, solely by reason of his/her disability, be excluded from the participation in, or be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal assistance. (29 USC s.794) An individual with disabilities is the same as "disabled person" defined in 34 CFR 104.3(j).  That definition is as follows: (j) "Disabled persons" means any person who (i) has a physical or mental impairment which substantially limits one or more major life activities, (ii) has a record of such an impairment, or (iii) is regarded as having such an impairment. To have a disability under Section 504, an individual must have an impairment that substantially limits a major life activity, which is an everyday activity an average person can perform with little or no difficulty. Bay District has policies and procedures in place to assure compliance with Section 504 regulations.  If you believe your child may meet the requirements for accommodations under this regulation, contact your child's school counselor.
